Booking procedure:
You can either allow us to select offers on your behalf (see offer inquiry) or you can inform us of the property you have chosen from our picture gallery. To make a booking, you will be forwarded a reservation agreement indicating details about the property, the owner's name and the General Terms and Conditions. By confirming the reservation agreement, you accept the General Terms and Conditions as quoted below.
Booking:
Reservation agreements are concluded on behalf of and with the authorisation of the respective property owner. All information has been carefully compiled and verified. Because Night&Day is an agency and not the owner of the property, no liability is assumed for this information. The booking comes into effect when the reservation agreement is submitted via fax, email or post and confirmed in writing by Night&Day. Night&Day renders only the services involved in concluding the reservation.By submitting your reservation/booking request to Night&Day, you make a binding offer to conclude an agreement with the property owner and a mediating agreement with Night&Day in accordance with the present mediation conditions.Night&Day acts merely as a consultant and/or mediator between yourself and the property owner. If the guest accepts the so-called reservation agreement, an accommodation/tenancy agreement comes into effect between the guest and property owner for the requested period. Claims to performance or warranty claims on the grounds of defects and any recourse claims resulting from inadequately rendered services or the non-performance of services booked with the property owner (landlord) may not be filed against Night&Day.
Payment:
Accommodation must be paid for in cash or by cheque upon arrival directly to the owner/landlord. Other methods of payment cannot be accepted. A deposit may be requested (usually 20%) so that only the balance is payable upon arrival. The agreed rent covers additional costs for electricity, gas, water and the proper use of available fittings and furnishings.Liability to pay costs: the landlord reserves the right to charge a cleaning fee and to request a deposit for the key. Please ask your landlord in advance how much this fee will be.
Changes: in exceptional cases, changes may be made to reservations. In such cases, Night&Day reserves the right to offer the guest a comparable property in the same category.
Arrival:
The landlord should be contacted directly and well in advance of the planned time of arrival. The guest is not entitled to accommodate other persons or more persons than those registered or pets in the rented property. The owner is entitled to turn away such persons or pets.
Departure:
Guests are requested to leave the property on the day of departure by 11 a.m. at the latest. Any exceptions to this rule must be agreed with the landlord.
Cancellation:
Cancellation of your reservation agreement is free up to 21 days prior to planned arrival. Any deposit paid shall be reimbursed. The following cancellation fees apply thereafter:
21 - 7 days prior to planned arrival: 20%
7 - 1 day(s) prior to planned arrival: 80%
from the planned day of arrival and in the event of late or early arrival: 100% of the total costs.
Night&Day is authorised by the landlord to demand the payment of cancellation fees on his behalf as compensation. On written request, special authorisation may be submitted. The guest reserves the right to furnish proof that loss has either not occurred at all or is significantly lower than the charged flat-rate cancellation fees. Cancellation must always be made in writing.
Cleaning:
The guest should leave the property in the clean and tidy condition in which he found it. The landlord reserves the right to request the payment of a cleaning fee which is due upon arrival. For many of the properties, a cleaning service may be arranged with the landlord against a fee. In the case of long-term bookings, the landlord is entitled to arrange for the property to be thoroughly cleaned within the framework of the house rules and regulations which is paid for separately. For periods of less than 4 - 5 days, an additional cleaning fee is not usually charged.
In view of the number of properties it manages, Night&Day cannot provide any binding information on cleaning fees. Please ask your landlord directly about this matter.
Smoking:
In the interests of subsequent guests, smoking is not permitted in the reserved properties. Exceptions should be agreed with the landlord.
Defects/liability/damage:
Complaints about the reserved property should be submitted in writing without delay to Night&Day. Night&Day assumes no liability for any lost or mislaid valuables.Night&Day assumes liability only for wilful or grossly negligent breaches of duty resulting form the mediation agreement.The tenant is liable for any damage to the property caused by himself, a relative, a pet or visitors.
Miscellaneous:
Night&Day is entitled to terminate the tenancy agreement with immediate effect and to demand the immediate evacuation of the property by the guest if the latter breaches his duty to take due care of the rented property, particularly if he takes in persons and/or animals other than those registered in the agreement, or if he inflicts wanton damage on the rented property or breaches the duties of an orderly tenant in any other way. In such cases, the guest is not entitled to proportional reimbursement of the rent.If fulfilment of the tenancy agreement is impeded, endangered or impaired as a result of force majeure which is not foreseeable at the time the tenancy agreement is signed, Night&Day is entitled to terminate the agreement. In such a case, Night&Day is entitled to demand appropriate compensation for costs already incurred or services already rendered.The descriptions contained in the gallery serve to individualise properties. They do not guarantee the existence of certain features. Deviations that become apparent on location do not represent defects, particularly when the guest documents his acceptance of such deviations by moving into the property.
Liability for occasional breakdowns and/or failures in power or water supplies is excluded, as is liability for occasional breakdowns caused by natural occurrences or local conditions.
The guest is entitled to demand remedial action either from the owner or his manager on location if he makes a legitimate complaint about defects to the property. However, this complaint must be lodged immediately. Remedial action may be refused if disproportionate effort is required.The guest may demand appropriate rent reduction for the length of time the property is not in the condition stated in the agreement. However, this presupposes that the guest reports the defects without delay. If the guest fails to lodge his complaint within 24 hours, he forfeits his right to remedial action, rent reduction and compensation. The extent of rent reduction is based on the valid law for comparable defects in long-term tenancy agreements for unfurnished accommodation. Cancellation of the contract is excluded, unless the defect is so serious that the property is inhabitable, for which the guest must furnish proof.
If some of the above conditions or parts thereof are or become invalid, the validity of the remaining provisions shall remain unaffected. In such a case, the ineffective condition shall be replaced by a condition whose economic sense and purpose comes closest to that of the ineffective condition.
By signing the reservation agreement, the guest accepts the validity of the booking conditions.
